A missed deadline: the difference between life and death

The Death Penalty Information Center has developed a database of capital appeals that were dismissed because they were not filed by the statutory deadline.

Between 1996-2004, it has been discovered through this database, that courts dismissed some or all of the claims in sixty cases without conducting any judicial review of the merits, including claims of actual innocence primarily because the claims were not filed in time.
